UAE Tax Residency Certificate Guide

A UAE tax residency certificate (TRC) is an official document from the Federal Tax Authority (FTA) confirming that a person is a tax resident of the UAE for a stated period. Its main commercial use is proving UAE residence to a foreign tax authority so that a double tax agreement (DTA) can be applied, most often to reduce withholding tax on dividends, interest, royalties or service fees paid from another country. The FTA issues it through the EmaraTax portal, and the application is where most delays begin.

What a TRC Is, and What It Isn't

A TRC is evidence of residence. It is not a treaty benefit in itself. The foreign payer and its tax authority still decide whether the treaty applies, and they will look at the certificate alongside other conditions such as beneficial ownership and anti-abuse tests. A UAE company with a valid TRC and a commercially sound structure normally meets these tests. A thin structure with a certificate attached may not.

The FTA issues several related documents, so it helps to be clear which one you need:

  • Tax residency certificate (non-treaty): for general proof of UAE residence.

  • Tax residency certificate (DTA): for claiming relief under a specific treaty. This usually requires the foreign country's own form to be completed and attested by the FTA.

  • Commercial Activities Certificate (CAC): a separate certificate for legal persons with an active VAT registration, valid for one year.

Who Can Get One

Companies and other legal persons. The FTA requires that a legal person has been incorporated or established for at least 12 months before applying. Branches of foreign companies and offshore companies are not eligible. A company that is part of a UAE tax group should note that the tax group itself is not treated as a UAE tax resident for this purpose, and group credentials cannot be used for discounted fees. Individual members may apply on their own account. Our guide to UAE Corporate Tax Groups covers how grouping works.

Individuals. A natural person qualifies under any one of three routes:

  • 183 days or more of physical presence in the UAE in a 12-month period.

  • 90 to 182 days, combined with either a permanent place of residence in the UAE or UAE employment or business activity.

  • Primary residence and centre of financial and personal interests in the UAE.

For individuals applying under a DTA, the UAE residence rules in the relevant treaty must also be met, and the treaty's own definition of residence can be stricter than the domestic tests.

Documents the FTA Asks For

The exact list depends on the applicant type and whether a treaty is involved. For a legal person applying for a non-treaty TRC, the FTA's service page lists:

  • A valid trade licence and lease agreement

  • Certificate of incorporation and Memorandum of Association

  • Emirates ID and passport of the authorised signatory, with proof of authorisation

  • Corporate Tax registration number, where available

  • Evidence of effective management and control in the UAE, where relevant

A DTA application is similar but typically needs a certified Memorandum of Association and the treaty country's international tax form. Individuals provide an Emirates ID or passport, an entry and exit report, and evidence of income or residence.

Some advisers also ask for audited financial statements and bank statements as supporting evidence. The FTA's own page does not list them as mandatory, but a foreign tax authority reviewing the certificate may ask for more, so they are worth having ready.

Fees

The FTA charges a non-refundable submission fee and a processing fee that depends on who is applying:

Item

Fee (AED)

Submission fee (non-refundable)

50

Electronic TRC, applicant with a Corporate Tax registration

500

Electronic TRC, individual without a Corporate Tax registration

1,000

Electronic TRC, legal person without a Corporate Tax registration

1,750

Commercial Activities Certificate

500

Each printed hard copy

250

Registered taxpayers therefore pay materially less, which is one more reason to keep Corporate Tax registration current.

What Period Does a TRC Cover?

A TRC covers one specific tax period, or any other 12-month period the applicant chooses. It cannot cover a future period and cannot exceed 12 months. There is no automatic renewal, so a company receiving treaty-covered income across several years needs a fresh certificate for each relevant period.

Timing rules matter for legal persons. The FTA allows an application once the company is three months into the relevant period, or after the period has ended. Natural persons can apply as soon as they meet the residence criteria. A group that expects a large dividend or royalty payment should apply early enough that the certificate is in hand before the foreign payer asks for it.

How Long It Takes

The FTA's stated service standard is 10 business days from receipt of a complete application. Printed copies take a further 5 business days after payment. Attestation of a treaty country's international form takes 10 business days after the completed form and fees are received, and requests are not processed if the form or fees are not provided within 30 business days.

Some advisory websites quote faster turnaround, but incomplete applications are the common cause of delay, so allow for the official timeline when planning a payment date.

How to Apply

  1. Log in to the EmaraTax portal using UAE Pass or your existing credentials.

  2. Select the tax residency certificate service and choose the applicant type, which sets the fee.

  3. Enter the residence details and select the period the certificate should cover.

  4. Upload the required documents.

  5. Pay the submission fee and submit.

  6. Pay the processing fee on approval and download the electronic certificate. Order printed copies separately if the foreign authority requires them.

Where Applications Go Wrong

  • Applying too early. A company that has not yet completed 12 months since incorporation will be rejected, regardless of how well the file is prepared.

  • Mismatched dates. The period on the certificate must match the period on the treaty country's form and the date of the payment being relieved.

  • Weak evidence of effective management. For foreign-incorporated companies and holding structures, board minutes, decision records and a real UAE presence matter. Our guide to the Economic Substance Regulations explains how substance is assessed in the UAE.

  • Assuming the TRC settles the treaty question. The foreign authority will test beneficial ownership and the commercial purpose of the structure.

  • Applying as a tax group. Group members must apply individually.

Planning Points for Groups

  • Map treaty-relevant income streams first. Dividends, interest, royalties and service fees from treaty jurisdictions are the ones where a TRC pays for itself.

  • Calendar the certificate. Diarise the application date against each payment cycle, since a certificate covers a single period and a late one can mean tax withheld at the full domestic rate and reclaimed later.

  • Align with your UAE position. Domestic reliefs such as the Participation Exemption deal with UAE tax on incoming dividends and gains. A TRC addresses the other side, tax withheld in the source country. A structure should be reviewed for both.

  • Check free zone and financial centre entities separately. Entities in free zones or financial centres can qualify as UAE tax residents, but the facts differ by structure. See our comparison of DIFC and ADGM and the wider GCC corporate tax comparison.

FAQs

What is a UAE tax residency certificate?

It is a certificate issued by the Federal Tax Authority confirming that a person is a UAE tax resident for a specified period. It is mainly used to claim relief under a double tax agreement.

Who can apply for a UAE tax residency certificate?

Individuals who meet one of the three residence routes, and legal persons that have been incorporated or established for at least 12 months. Branches of foreign companies and offshore companies are not eligible.

How much does a UAE tax residency certificate cost?

The submission fee is AED 50. The processing fee is AED 500 for applicants with a Corporate Tax registration, AED 1,000 for individuals without one and AED 1,750 for legal persons without one. Printed copies cost AED 250 each. Confirm current amounts on the FTA portal before paying, as fees can change.

How long is a UAE tax residency certificate valid?

It covers a single tax period or a chosen 12-month period, and cannot cover a future period. A new application is needed for each period.

How long does it take to get one?

The FTA's service standard is 10 business days from a complete application, plus 5 business days for printed copies.

Can a company in a tax group apply for a TRC?

The tax group itself is not treated as a UAE tax resident for this purpose. Each member applies individually.

Does a TRC guarantee a lower withholding tax rate abroad?

No. It proves UAE residence. The foreign tax authority decides whether the treaty applies, usually after testing beneficial ownership and the commercial purpose of the structure.

This article reflects the FTA's published tax residency certificate requirements and Cabinet Decision No. 85 of 2022, current as of October 2026. Fees, documents and timelines can change, and treaty eligibility depends on the specific agreement and facts. Speak to our team before relying on general guidance for a treaty claim.
